The Wild World of Protogames Video Contest

Official Contest Rules
 

 

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT IMPROVE ONE’S CHANCES OF WINNING. This is a single contest with official rules based on residency of the participant. The selection of the winners will be made among all eligible participants worldwide. The prizes are allocated to the winners which have been selected on a worldwide basis.

 

 

OFFICIAL RULES FOR RESIDENTS OF THE UNITED STATES, CANADA AND MEXICO ONLY

 

 

1.                  Eligibility: Except where regulated or restricted by law, the Wild World of Protogames Video Contest (“Contest”) is open only to legal residents of the 50 United States of America, the District of Columbia, of all provinces and territories in Canada (excluding residents of Quebec), and of the United States of Mexico who are the age of majority or older (eighteen (18) years of age in most jurisdictions) as of the date of entry.  Employees, contractors, directors, and officers of the sponsor, Carbine, LLC (“Sponsor”), and its subsidiary and affiliated companies, distributors and licensees, advertising or promotion agencies, and their immediate family members (parent, child, sibling, and spouse of each), and those living in the same household of each are NOT ELIGIBLE TO ENTER OR WIN.  Other eligibility requirements and conditions of participation are set forth below in these official rules for the Contest (“Official Contest Rules”). All federal, state, provincial, municipal, and local laws and regulations apply. Void where prohibited or restricted by law.

 

2.                  How to Enter: To enter, eligible participants must have a Youtube.com account.  A participant may, but is not required to, have created a player character on www.wildstar-online.com (“Website”). To enter the Contest, participants must create a 30-second movie-trailer style video showing what the participant loves about the latest WildStar update, the Protogames Initiative (“Video”).  The Video must be from Drop 1.2.0, the Protostar Initiative.  The Video can be in-game, live-action, machinima, stop-motion, or any other format of the participant’s choosing.  The key is to be creative and unique.  After completing the Video, the participant must then upload the Video to Youtube.com and then enter the Video URL onto the Contest’s Facebook page using an application from Woobox.com available at [FACEBOOK LINK FOR CONTEST] (“Contest Facebook Page”) along with the participant’s name and email.  Upon creation and submission of a Video in accordance with these Official Contest Rules, the participant will be entered into the Contest (“Entrant”).  The following requirements apply for each Video:

 

  • To submit a Video for entry into the Contest, the Entrant must first have an active YouTube.com account.  The Entrant must then create a Video showing what the Entrant loves about The Protogames Initiative.  The Video must contain a WildStar logo and a link to the Website.  The WildStar logo will be provided to participants in the news post announcing this Contest.  The Video may not exceed 30 seconds in length.  The Video description must include the following statement: “This video is submitted as an entry in the Wild World of Protogames Video Contest.”  Any Video that does not include this statement in its description will be void.  After creating the Video, the Entrant must upload the Video to the Entrant’s YouTube.com account.  To complete the entry process, the Entrant must post a website link for the Video on YouTube.com to the Contest Facebook Page.  The post to the Contest Facebook Page must include the Entrant’s name and email. This information will not be publicly visible.

 

3.                  Entry Period:  Entries will only be considered “Valid” if they are posted to the Contest Facebook Page between 9:00 AM Pacific Standard Time (“PST”) on [February 16, 2015] and 11:59 PM PST on [March 2, 2015] (“Entry Period”).  Completing a post to the Contest Facebook Page with a YouTube.com link to a Video constitutes entry (“Entry” or “Entries”) into the Contest and Entrant’s consent to and agreement with these Official Contest Rules.   

 

4.                  Entry Limit:  Limit of One Entry per Entrant.  Subsequent Entries by the same Entrant are invalid and will be disqualified.  Any attempts made by the same person to submit multiple Entries during the Entry Period are void.  In the event of a dispute over the identity of the Entrant, the Entry will be deemed submitted by the authorized account holder of the email account submitted at the time of entry into the Contest.  All Entries must be received during the Entry Period in order to be eligible for any Prize offered in this Contest.  Any Entries submitted before or after the Entry Period are void and will not be eligible for a Prize. 

 

Neither Sponsor, nor any telephone network, nor any service provider is responsible for incorrect transcription of Entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures or any telephone network, computer equipment, software, inability to access any website or online service, or any other error or malfunction, or late, lost, illegible, incomplete, damaged, or misdirected entries or entries not properly forwarded to Sponsor. 

 

5.                  Conditions of Video:  Any Video that is deemed by the Sponsor, in its sole discretion, to be infringing, offensive, immoral, obscene, profane, defamatory, not keeping with the image of the Sponsor, or in violation of these Official Contest Rules will be void.  If a Video depicts a minor (under eighteen (18) years of age at the time of the Video), the minor’s parent or legal guardian must have consented to such use. Further, all Videos that contain trademarks, copyright-protected or other proprietary materials for which the Entrant has not obtained appropriate assignment of rights, as well as any content that disparages or portrays the Sponsor in a negative light, will be void.  Sponsor reserves the right, at its sole discretion, to void any Entries from Entrants whom Sponsor believes have attempted to tamper or have tampered with the administration, security, or fairness of this Contest.  Entries submitted by automatic, programmed, or like methods will be disqualified.

 

By entering, each Entrant warrants and represents that (i) the Video is the original work of the Entrant and does not infringe the intellectual property, privacy, confidentiality or publicity rights or any other legal rights of any third party; (ii) the Entrant owns or otherwise controls all rights to the Video submitted by the Entrant; and (iii) the Video has not been entered into or won any previous contests or awards and has not been published or distributed previously in any form of media.  By entering this Contest, each Entrant unconditionally and irrevocably grants a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable license to Sponsor and its successors or assigns to use, reproduce, distribute, display, and create derivative works of the Video for any purpose now and hereafter as they so desire.  Each Entrant further warrants and represents that any person or entity in the Video has agreed to be featured and for the Video to be posted on social media, and must also have agreed to the Video being entered in the Contest, and each Entrant further warrants and represents that applicable consents have been obtained.  By submitting a Video, Entrant grants Sponsor the right to use, publish, adapt, edit and/or modify such Video in any way, in whole or in part, and to use such Video alone or in combination with other works, as solely determined by Sponsor, in commerce and trade and in any and all media now known or hereafter discovered, without limitation or compensation to the Entrant and without right of notice, review, or approval of any such use of the Video. 

 

6.                  Voting:  Each Video will be posted on the Contest Facebook Page and will be eligible for voting by the public upon posting.  Prior to posting, however, each Video will be screened by the Sponsor for submission to ensure compliance with these Official Contest Rules prior to posting of the Video to the voting gallery (“Voting Gallery”) on the Contest Facebook Page.    Videos will be available for voting by the public immediately upon posting to the Voting Gallery.  Voting will occur from the beginning of the Entry Period, 9:00 AM PST on [February 16, 2015], through 11:59 PM PST on [March 10, 2015] (“Voting Period”).  Limit of one vote per Facebook account.  Votes should be based on the following criteria: (a) Passion (25%); (; Creativity (25%); and © Originality (50%).  Entrants are strictly prohibited from offering compensation, in any form whatsoever including monetary or otherwise, in exchange for votes.  Sponsor reserves the right, in its sole discretion, to disqualify any Entrant determined to be soliciting votes through an offer of compensation.  Entrants, however, may request votes from friends, blog communities, Facebook groups, or similar communication mechanism; provided that the Entrant does not offer or provide any compensation, monetary or otherwise, as part of the request.  If it is discovered that attempts were made by any individual to use (or attempt to use) any automated, script, macro, robotic or other program(s) to generate votes in a manner that the Sponsor deems, in its sole and absolute discretion, to violate the letter and spirit of this Contest, then it may result in the disqualification, in the sole and absolute discretion of the Sponsor, of the votes, Video and/or Entrant to which such votes relate.

 

7.                  Selection of the Worldwide Winners:  There will be three winners of the Contest selected among all the eligible participants on a worldwide basis (each a “Winner” and collectively, the “Winners”).  The Winners will be the three Entrants whose Videos received the three highest number of votes during the Voting Period.  All votes will be cumulative throughout the Voting Period.  The Winners will be announced at 11:00 a.m. Pacific Daylight Time on [March 17, 2015] via Zero to Fifty Livestream.  The Sponsor’s determination of the Winners based upon the total number of votes received during the Voting Period is final and binding and not subject to review or appeal.  For Winners residing in Canada, before being confirmed as a Winner, the selected Entrant must correctly answer unaided, a time limited mathematical skill-testing question administered by email or telephone.

 

8.                  Prizes and Approximate Retail Value (“ARV”) in US Dollars:  Each of the Winners will receive the following prize (“Prize”):  (1) a Logitech G300S Gaming Mouse (ARV $39.99); (2) a Logitech G910 Orion Spark RGB Mechanical Gaming Keyboard (ARV $179.00); (3) a Logitech G430 Surround Sound Gaming Headset (ARV $79.99); (4) 30-day game time codes (ARV $15.00); and (5) 12x26 Art Prints (ARV $2.50), for a total ARV per Prize of $318.46.  The total ARV of all Prizes is $955.38.

 

9.                  Prize Conditions:  All costs associated with acceptance or use of the Prize, are the sole responsibility of the Winner.  The Winner may waive his/her right to receive a Prize.  A Prize is non-transferable, non-exchangeable, and non-refundable, has no cash value, and must be accepted by the Winner as awarded unless the Winner waives his/her right to receive a Prize.  A Prize may not be upgraded, and no substitutions by the Winner will be allowed, except that Sponsor reserves the right, in its sole discretion, to substitute a Prize for one of equal or greater value if the designated Prize should be unavailable for any reason.

 

10.              Odds of Winning: Odds of winning depend on the total number of eligible Entries received during the Entry Period and the quality of the Videos submitted.

 

11.              How to Claim Your Prize: Winners will be contacted by a representative from the Sponsor on or about [March 17, 2015], the date when the Winners are announced.  The Winners will be notified using the email submitted by the Entrant when posting the Video URL on the Contest Facebook Page.  The list of Winners will also be posted on the Website and in the WildStar forums.  In the event a Winner cannot be contacted within seven (7) days after the Winners announcement on [March 17, 2015], as determined in the sole discretion of Sponsor or its representatives, or a Winner rejects a Prize, an alternative winner may be identified.  At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) potential Winner’s failure to timely respond to the notification; (2) the return of the notification as undeliverable; or (3) any other non-compliance with the Official Contest Rules. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner.  The Sponsor shall not be responsible or liable for any failure by a potential Winner to accept the Prize for any reason.

 

12.              Prize Delivery:  The physical items of the Prize will be shipped, and the game time code will be emailed, within 30 days after Sponsor verifies the Winner’s eligibility to enter and to win this Contest. 

 

13.              Conditions, Disclaimers, and License:  By entering the Contest, each Entrant agrees that: (a) he or she will abide by and be bound by these Official Contest Rules; ( B) the Entry, including the Video, will not be acknowledged by Sponsor; © Youtube, Facebook and Sponsor or any of its affiliated companies or the advertising and promotional agencies affiliated with Sponsor or those affiliated companies, or any of their officers, directors, employees, agents or representatives (collectively, Sponsor’s “Affiliates”) are not responsible for claims, injuries, death, losses or damages of any kind resulting from participation or inability to participate in the Contest, or the awarding, acceptance, use, misuse, possession, loss or misdirection of a Prize; (d) Sponsor is not responsible for any inability of a Winner to accept a Prize for any reason; and (e) by entering the Contest, all Entrants further agree that Sponsor has the sole right to decide all matters relating to the Contest, including fact, interpretation, eligibility, procedure, fulfillment, and disputes from the Contest.

 

Although Sponsor attempts to ensure the integrity of the Contest, neither Sponsor nor any of the Affiliates are responsible for the actions of Entrants or other individuals in connection with the Contest, including attempts by Entrants or other individuals to circumvent these Official Contest Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest.  If, for any reason, the Contest is not capable of running as planned by reason of damage by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical limitations or failures, strikes, industry conditions, bankruptcy or liquidation, marketplace demands, applicable law, unforeseen obstacles, or any other causes which, in the sole opinion of Sponsor, could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the Contest, Sponsor reserves the right in its sole and absolute discretion to modify these Official Contest Rules, and/or to cancel, terminate, modify or suspend all or any part of the Contest, and in the event of cancellation or termination, to select a Winner from among all eligible non-suspect Entries received up to the time of such cancellation, termination, modification, or suspension, as applicable.  If the Contest is terminated by Sponsor as set forth above, Sponsor will post notice of such termination on the WildStar forums and the Facebook page.  Inclusion in such drawing will be each Entrant’s sole and exclusive remedy under such circumstances.  Proof of submitting an Entry will not be deemed receipt of such Entry by Sponsor.

 

14.              Release and Indemnification:  BY ENTERING THE CONTEST, ENTRANTS RELEASE AND HOLD THE SPONSOR, ITS AFFILIATES, FACEBOOK AND YOUTUBE HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHT, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE CONTEST OR PARTICIPATION IN ANY CONTEST-RELATED ACTIVITY, INCLUDING WITHOUT LIMITATION, ACCESS TO ANY MATERIALS, OR RESULTING DIRECTLY OR INDIRECTLY FROM THE PRODUCTION OR SUBMISSION OF A VIDEO INCLUDING, WITHOUT LIMITATION, ANY TRAVEL OR OTHER ACTIVITIES RELATED TO THE ENTRANT’S PRODUCTION OR SUBMISSION OF A VIDEO FOR THE CONTEST, OR FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THE CONTEST, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY.

 

Each Entrant agrees to defend, indemnify and hold harmless the Sponsor and its Affiliates from any and all claims, liabilities, damages, expenses and costs (including legal fees) brought or asserted by or on behalf of any third party against the Sponsor or its Affiliates arising from or related to the Entrant’s Video infringing or allegedly infringing a third party’s intellectual property rights, publicity, privacy or confidentiality rights, or defaming or otherwise causing harm to a third party.

 

15.              Limitations on Liability:  Youtube, Facebook, Sponsor and its Affiliates shall not be liable to any Winner or any other person for failure to supply a Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s or its Affiliates’ sole control.

 

16.              Miscellaneous:

 

(a) Privacy:  Information submitted in connection with the Contest will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently available at http://www.wildstar-.../privacy-policy; provided, that in the event of any conflict between these Official Contest Rules and such Privacy Policy, the terms and conditions of these Official Contest Rules shall prevail.  

 

(B) Publicity Release:  Except where prohibited, by accepting a Prize, each Winner grants permission for Sponsor and its agents to use his/her name, voice and/or likeness, for advertising, merchandising, promotion and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.

 

© Applicable Law: The Contest, and any disputes that may arise hereunder, shall be governed in all respects by the laws of the state of Washington without regard to the conflicts of laws principles of any jurisdiction.  Venue with respect to any such disputes shall be had in the state and federal courts of the state of Washington.

 

17.              Official Rules:  By participating in the Contest, each Entrant fully and unconditionally agrees to and accepts these Official Contest Rules and decisions of the Sponsor, which are final and binding in all matters relating to the Contest.  The Contest will be run in accordance with the Official Contest Rules, subject to amendment by Sponsor.  Each Entrant must comply with the Official Contest Rules and will be deemed to have received and understood the Official Contest Rules by participating in the Contest.  The terms of the Contest, as set out in the Official Contest Rules, are not subject to amendment or counteroffer, except as set out herein.  If any provisions of the Official Contest Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.  Sponsor’s failure to enforce any term of these Official Contest Rules will not constitute a waiver of that provision.

19.              Winner List:  For a list of Winners, send a self-addressed, stamped envelope (except residents of Vermont) to: Carbine, LLC, Attn: Winner List Wild World of Protogames Video Contest, 95 Enterprise Suite 100, Aliso Viejo, CA 92656,USA by [June 10, 2015].  A list of the Winners also will be posted on the WildStar forums and the Facebook page.

 

20.              Disclaimer:  The Contest is in no way sponsored, endorsed, or administered by, or associated with YouTube or Facebook.  By participating, you agree that you are providing your information to the Sponsor and not to Facebook.

1.                  Eligibility: The Wild World of Protogames Video Contest (“Contest”) is open only to residents of a member state of the European Union, Iceland, Montenegro, Norway, Serbia, Switzerland, Turkey (for the purpose of this Contest, residents of these countries will also be deemed part of the European Union) who are the age of majority or older (eighteen (18) years of age in most jurisdictions) as of the date of entry.  Employees, contractors, directors, and officers of the sponsor, Carbine, LLC (“Sponsor”), and its subsidiary and affiliated companies, distributors and licensees, advertising or promotion agencies, and their immediate family members (parent, child, sibling, and spouse of each), and those living in the same household of each are NOT ELIGIBLE TO ENTER OR WIN.  Other eligibility requirements and conditions of participation are set forth below in these official rules for the Contest (“Official Contest Rules”). All federal, state, provincial, municipal, and local laws and regulations apply.

Further, all Videos that contain trademarks, copyright-protected or other proprietary materials for which the Entrant has not obtained appropriate assignment of rights, as well as any content that disparages or portrays the Sponsor in a negative light, will be void.  Sponsor reserves the right, at its sole discretion, to void any Entries from Entrants whom Sponsor believes have attempted to tamper or have tampered with the administration, security, or fairness of this Contest.  Entries submitted by automatic, programmed, or like methods will be disqualified.

 

By entering, each Entrant warrants and represents that (i) the Video is the original work of the Entrant and does not infringe the intellectual property, privacy, confidentiality or publicity rights or any other legal rights of any third party; (ii) the Entrant owns or otherwise controls all rights to the Video submitted by the Entrant with possible exception of any footage of “WildStar” which is controlled by the Sponsor; and (iii) the Video has not been entered into or won any previous contests or awards and has not been published or distributed previously in any form of media.  By entering this Contest, each Entrant unconditionally and irrevocably grants a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable license to Sponsor and its successors or assigns to use, reproduce, distribute, display, and create derivative works of the Video for any purpose now and hereafter as they so desire, including but not limited to the right to publish such video or parts of it and to claim any advertising revenues on YouTube or any other online video platform, to use the video or parts of it for advertising “WildStar” or any other product or company, to publish the video on any data carrier including but not limited to any bundle with any computer game or other content, to make the video publicly available without regard to the distribution scheme, including but not limited to (free) video on demand, download to own, download to rent, pay per view or pay per download, the right to exploit the video or parts of it via broadcasting or satellite TV, including but not limited to pay TV, free TV, closed circuit networks or live streams, to use stills or screenshots of the video for advertising of “WildStar” or any other product or company.  Each Entrant further warrants and represents that any person or entity in the Video has agreed to be featured and for the Video to be posted on social media, and must also have agreed to the Video being entered in the Contest, and each Entrant further warrants and represents that applicable consents have been obtained.  By submitting a Video, Entrant grants Sponsor the right to use, publish, adapt, edit and/or modify such Video in any way, in whole or in part, and to use such Video alone or in combination with other works, as solely determined by Sponsor, in commerce and trade and in any and all media now known or hereafter discovered, without limitation or compensation to the Entrant and without right of notice, review, or approval of any such use of the Video. 

 

6.                  Voting:  Each Video will be posted on the Contest Facebook Page and will be eligible for voting by the public upon posting.  Prior to posting, however, each Video will be screened by the Sponsor for submission to ensure compliance with these Official Contest Rules prior to posting of the Video to the voting gallery (“Voting Gallery”) on the Contest Facebook Page.    Videos will be available for voting by the public immediately upon posting to the Voting Gallery.  Voting will occur from the beginning of the Entry Period, [6:00 PM CEST on February 16, 2015, through 11:59 PM CEST on March 10, 2015] (“Voting Period”).  Limit of one vote per Facebook account.  Votes should be based on the following criteria: (a) Passion (25%); (B) Creativity (25%); and © Originality (50%).  Entrants are strictly prohibited from offering compensation, in any form whatsoever including monetary or otherwise, in exchange for votes.  Sponsor reserves the right, in its sole discretion, to disqualify any Entrant determined to be soliciting votes through an offer of compensation.  Entrants, however, may request votes from friends, blog communities, Facebook groups, or similar communication mechanism; provided that the Entrant does not offer or provide any compensation, monetary or otherwise, as part of the request.  If it is discovered that attempts were made by any individual to use (or attempt to use) any automated, script, macro, robotic or other program(s) to generate votes in a manner that the Sponsor deems, in its sole and absolute discretion, to violate the letter and spirit of this Contest, then it may result in the disqualification, in the sole and absolute discretion of the Sponsor, of the votes, Video and/or Entrant to which such votes relate.

 

7.                  Selection of the Worldwide Winners:  There will be three winners of the Contest selected among all the eligible participants on a worldwide basis (each a “Winner” and collectively, the “Winners”).  The Winners will be the three Entrants whose Videos received the three highest number of votes during the Voting Period.  All votes will be cumulative throughout the Voting Period.  The Winners will be announced at [6:00 p.m. Central European Daylight Time on March 17, 2015] via Zero to Fifty Livestream.  The Sponsor’s determination of the Winners based upon the total number of votes received during the Voting Period is final and binding and not subject to review or appeal. 

 

8.                  Prizes and Approximate Retail Value (“ARV”) in Euro:  Each of the Winners will receive the following prize (“Prize”):  (1) a Logitech G300S Gaming Mouse (ARV $39.99); (2) a Logitech G910 Orion Spark RGB Mechanical Gaming Keyboard (ARV $179.00); (3) a Logitech G430 Surround Sound Gaming Headset (ARV $79.99); (4) 30-day game time codes (ARV $15.00); and (5) 12x26 Art Prints (ARV $2.50), for a total ARV per Prize of $318.46.  The total ARV of all Prizes is $955.38.

 

9.                  Prize Conditions:  All costs associated with acceptance or use of the Prize, are the sole responsibility of the Winner.  The Winner may waive his/her right to receive a Prize.  A Prize is non-transferable, non-exchangeable, and non-refundable, has no cash value, and must be accepted by the Winner as awarded unless the Winner waives his/her right to receive a Prize.  A Prize may not be upgraded, and no substitutions by the Winner will be allowed, except that Sponsor reserves the right, in its sole discretion, to substitute a Prize for one of equal or greater value if the designated Prize should be unavailable without Sponsor’s fault, even though the Sponsor ordered the prizes from its suppliers.

 

10.              Odds of Winning the Contest: Odds of winning the Contest depend on the total number of eligible Entries received during the Entry Period, the quality of the Videos submitted and the number of votes based on the following criteria including (a) passion (25%); creativity (25%); and originality (50%).

 

11.              How to Claim Your Prize: Winners will be contacted by a representative from the Sponsor on or about [March 17, 2015], the date when the Winners are announced.  The Winners will be notified using the email submitted by the Entrant when posting the Video URL on the Contest Facebook Page.  The list of Winners will also be posted on the Website and in the WildStar forums.  In the event a Winner cannot be contacted within seven (7) days after the Winners announcement on [March 17, 2015], as reasonably determined by Sponsor or its representatives, or a Winner rejects a Prize, an alternative winner may be identified.  At the reasonable discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) potential Winner’s failure to timely respond to the notification; (2) the return of the notification as undeliverable; or (3) any other non-compliance with the Official Contest Rules. In the event of a prize forfeiture, the Sponsor may, in its reasonable discretion, award or not award the forfeited prize to an alternate winner.  The Sponsor shall not be responsible or liable for any failure by a potential Winner to accept the Prize for any reason.

 

12.              Prize Delivery:  The physical items of the Prize will be shipped, and the game time code will be emailed, within 30 days after Sponsor verifies the Winner’s eligibility to enter and to win this Contest. 

 

13.              Conditions, Disclaimers, and License:  By entering the Contest, each Entrant agrees that: (a) he or she will abide by and be bound by these Official Contest Rules; (B) the Entry, including the Video, will not be acknowledged by Sponsor; © except where prohibited by law, Youtube, Facebook and Sponsor or any of its affiliated companies or the advertising and promotional agencies affiliated with Sponsor or those affiliated companies, or any of their officers, directors, employees, agents or representatives (collectively, Sponsor’s “Affiliates”) are not responsible for claims, losses or damages of any kind resulting from participation or inability to participate in the Contest, or the awarding, acceptance, use, misuse, possession, loss or misdirection of a Prize; (d) Sponsor is not responsible for any inability of a Winner to accept a Prize for any reason unless caused by the fault of Sponsor; and (e)  except where prohibited by law, by entering the Contest, all Entrants further agree that Sponsor has the sole right to decide all matters relating to the Contest, including fact, interpretation, eligibility, procedure, fulfillment, and disputes from the Contest. Section © and (e) are not applicable if the Entrant is a resident of Germany.

Although Sponsor attempts to ensure the integrity of the Contest, neither Sponsor nor any of the Affiliates are responsible for the actions of Entrants or other individuals in connection with the Contest, including attempts by Entrants or other individuals to circumvent these Official Contest Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest.  If, for any reason other than fault of Sponsor, the Contest is not capable of running as planned by reason of damage by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical limitations or failures, strikes, industry conditions, bankruptcy or liquidation, marketplace demands, applicable law, unforeseen obstacles, acts of God or any other causes which, in the sole opinion of Sponsor, could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the Contest, Sponsor reserves the right to modify these Official Contest Rules, and/or to cancel, terminate, modify or suspend all or any part of the Contest, and in the event of cancellation or termination, to select a Winner from among all eligible non-suspect Entries received up to the time of such cancellation, termination, modification, or suspension, as applicable.  If the Contest is terminated by Sponsor as set forth above, Sponsor will post notice of such termination on the WildStar forums and the Facebook page.  Inclusion in such drawing will be each Entrant’s sole and exclusive remedy under such circumstances.  Proof of submitting an Entry will not be deemed receipt of such Entry by Sponsor.

 

14.              Release and Indemnification:  EXCEPT WHERE PROHIBITED BY LAW, BY ENTERING THE CONTEST, ENTRANTS RELEASE AND HOLD THE SPONSOR, ITS AFFILIATES, FACEBOOK AND YOUTUBE HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHT, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE CONTEST OR PARTICIPATION IN ANY CONTEST-RELATED ACTIVITY, INCLUDING WITHOUT LIMITATION, ACCESS TO ANY MATERIALS, OR RESULTING DIRECTLY OR INDIRECTLY FROM THE PRODUCTION OR SUBMISSION OF A VIDEO INCLUDING, WITHOUT LIMITATION, ANY TRAVEL OR OTHER ACTIVITIES RELATED TO THE ENTRANT’S PRODUCTION OR SUBMISSION OF A VIDEO FOR THE CONTEST, OR FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THE CONTEST, INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY. This clause is not applicable if the Entrant is a resident of Germany.

 

Each Entrant agrees to defend, indemnify and hold harmless the Sponsor and its Affiliates from any and all claims, liabilities, damages, expenses and costs (including legal fees) brought or asserted by or on behalf of any third party against the Sponsor or its Affiliates arising from or related to the Entrant’s Video infringing or allegedly infringing a third party’s intellectual property rights, publicity, privacy or confidentiality rights, or defaming or otherwise causing harm to a third party. This clause is not applicable if the Entrant is a resident of Germany.

 

If the Entrant is a resident of Germany, you are liable to hold the Sponsor harmless from and against any losses, damages, right, claims and actions in accordance with the provisions of the German Civil Code. Sponsor shall only be fully liable for damages if such damages were caused by gross negligence or intentional acts of Sponsor, its employees, agents and officers; in the case of simple negligence Sponsor is only liable for personal injury and death arising out of its negligence; and for breach of contractual obligations which the Entrant could trust not to be breached and which are essential to perform under this agreement and in this case only, liability is limited to the typical foreseeable damages. The Entrant’s rights under the German Product Liability Act remain unaffected. Where liability is excluded or limited, such exclusion or limitation shall also be extended to Sponsor’s parent company, affiliates and subsidiaries and their respective employees, agents and officers.

 

15.              Limitations on Liability:  Except where prohibited by law, Youtube, Facebook, Sponsor and its Affiliates shall not be liable to any Winner or any other person for failure to supply a Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s or its Affiliates’ sole control.

 

16.              Miscellaneous:

 

(a) Privacy:  Information submitted in connection with the Contest will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently available at http://www.wildstar-.../privacy-policy; provided, that in the event of any conflict between these Official Contest Rules and such Privacy Policy, the terms and conditions of these Official Contest Rules shall prevail.  

 

(B) Publicity Release:  Except where prohibited by law, by accepting a Prize, each Winner grants permission for Sponsor and its agents to use his/her name, voice and/or likeness, for advertising, merchandising, promotion and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.

 

© Applicable Law: The Contest, and any disputes that may arise hereunder, shall be governed in all respects by the laws of the state of Washington without regard to the conflicts of laws principles of any jurisdiction, but shall be subject to the mandatory consumer protection provisions of the country of residence of the Entrant.  Unless the Entrant is a resident of Germany or France, venue with respect to any such disputes shall be had in the state and federal courts of the state of Washington. If the Entrant is a resident of France, the competent court will be determined according to French law.

 

17.              Official Rules:  The Contest will be run in accordance with the Official Contest Rules.  Each Entrant must comply with the Official Contest Rules.  The terms of the Contest, as set out in the Official Contest Rules, are not subject to amendment or counteroffer, except as set out herein.  If any provisions of the Official Contest Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.  Sponsor’s failure to enforce any term of these Official Contest Rules will not constitute a waiver of that provision.

When I submitted a video I didn't see a specific location to input my name.  Is that taken care of by the fact I submitted it through a facebook account?

Really wish the time period for submitting the video had been a lot longer. I feel this killed the contest for me and many others.

 

But best of luck to those who managed it.

Actually this is very common, it's due to Quebec rules, they have their own set for these. They're not just left out of WildStar contests on purpose. If you check other contests Quebec is more often than not unable to participate. :) Even from major contests all across various counties.
